Insurance Lawyer – Insurance Attorney

Battling insurance companies can be difficult. They have seemingly endless resources and can wear down their customers until they give up.

Has your auto insurance company refused to pay benefits under your uninsured or underinsured motorists’ coverage? Have you had a life insurance claim denied because the policyholder committed suicide? Did the insurance company refuse to pay double indemnity when your family member died in an accident?

Insurance companies are willing to go to great lengths to protect their bottom line. As such, they routinely offer injured people less than their case is worth and deny valid claims if they can find a loophole.

Insurance companies are required by law to pay financial recovery on all valid claims and to do so in a reasonable amount of time. You have a right to expect that the insurance company will act in good faith and pay your claim after an accident. Unfortunately, this does not always happen. Insurance companies have the incentive to deny claims or minimize payouts to increase their bottom line. This leaves accident victims with few options and hefty costs that they cannot afford. The insurance companies assume that many people will never dispute the claim denial, and many do not.

What is Policy Exclusion?

When insurance companies draft policies, they purposefully exclude certain types of losses from coverage. Losses that are not covered by the policy are called exclusions. Often, policyholders are not even aware of the exclusions until they try to bring a claim and the insurance company denies the claim. For example, a spouse may bring a life insurance policy claim after the death of a husband or wife only to have the insurance company cite a policy exclusion for failing to disclose a medical condition when denying payment on the policy.

What many people don’t know is that some exclusions in insurance policies are actually illegal and cannot be enforced by the insurance company. For instance, in Missouri, insurance companies cannot enforce a provision that excludes death by suicide unless the person bought the policy in anticipation or contemplation of suicide.

In this case, the insurance company can be forced to make good on their policy. And if the insurance company acted in bad faith, we can also pursue punitive damages and attorney fees.

At The Hoffmann Law Firm, L.L.C. we handle insurance disputes involving:

  • Failure to pay on a life insurance claim based on a technicality or policy exclusion
  • Denial of auto insurance benefits for injuries and damages in a car accident with an uninsured or underinsured driver
  • Refusal to pay valid claims under medical payments (med-pay) coverage, health insurance, homeowner’s insurance or fire insurance
  • The extent of coverage or the interpretation of policy language.
