Determining who is responsible depends on negligence—whether the driver or the pet owner failed to act with reasonable care.
When the Pet Owner Is Liable
In Missouri, fault in an accident is determined by negligence. A pet owner may be considered negligent if their failure to control the animal directly causes the accident.
The dog ran into the street because it wasn’t on a leash or fenced in.
The owner failed to secure the gate or chain the dog, allowing it to escape.
If the owner’s negligence caused the pet to run into traffic, the driver is generally not liable—especially if they had no reasonable opportunity to avoid the accident. In this case, the pet owner may be responsible for:
